The order passed by the Industrial Court, Kolhapur setting aside the dismissal for default order passed by the Labour Court, Ratnagiri below Exhibit U-1 is challenged by the Maharashtra State Road Transport Corporation.

Heard learned counsel for the Petitioner. Perused the documents placed on record.

Though the Respondent - Original Complainant was not diligent in prosecuting his complaint, however reasonable and fair opportunity needs to be given to him to prosecute his case. Shantanu S. Dhudum

The Industrial Court, Kolhapur has imposed the cost of Rs.2500/- while setting aside the dismissal for default order. The said order is passed by assigning cogent reasons. There is no illegality and perversity in the impugned order. No case is made out by the Petitioner to exercise extraordinary writ jurisdiction. The Writ Petition is therefore dismissed.
