The petitioner is not the person who participated in the tendering process pursuant to Tender Notice dated 14th August 2025. In "NHAI v. Gwalior Jhansi"1, the Hon'ble Supreme Court held that a person who did not participate in the tendering process shall have no right to challenge award of tender in favour of another party. The learned counsel for the petitioner submits that in paragraph no.22 of the writ petition, the petitioner states as under:

"22. Petitioner further states that the respondent no.4 at the request of the petitioner and another unit had submitted bid in the tender process. In any case, it was duty of the Board to sell and to arrange to sale the product of the village industries. The respondent no.4-Board in discharge of its duties had participated in the tender process. Thus, the petitioner and other (2018) 8 SCC 243 1/2 908-WP-77-2026.doc Dixit

units of village industries were direct beneficiaries of the said tender work. Petitioner states and submits that in view thereof, petitioner is aggrieved by the rejection of 4th respondent's bid and also affected by the impugned decision."
