As soon as the petition was called out, learned Counsel for the petitioner sought leave to withdraw the petition as the petitioner intends to pursue his remedy before the Joint Charity Commissioner, Pune, by filing an application in the proceeding already filed by a party under Section 36 of the Maharashtra Public Trusts Act, 1950. Petition is accordingly disposed of as withdrawn with liberty as prayed.

Needless to state, that if any application is filed before the Joint Charity Commissioner, Pune, the same to be decided in accordance with law.
