The Petitioner has prayed that the pending Appeal dated 01.11.2025, against the Disciplinary Action initiated against him vide order dated 10.10.2025, be decided.

Today, the learned Advocate for the Petitioner submits that he has been served with an order (undated), which is said to have been signed by the Chief General Manager on 03.01.2026 and served upon the Petitioner on 07.01.2026, indicating that the Appeal has been decided.

The Petitioner desires to challenge the decision in the Appeal as well as the Disciplinary Action dated 10.10.2025, by Sufiyan Syed - PA
911.AS.WP.141.2026.odt preferring a composite Writ Petition. Hence, we grant leave to withdraw this Petition and file a fresh Petition. 4.
In view of the above, this Petition is disposed off with liberty as is prayed for.

Considering the law laid down by the Hon'ble Supreme Court in Hindustan Lever Ltd vs. Ashok Vishnu Kate & Ors. 1996 AIR 285, interim relief restraining the authority from effecting the Disciplinary Action, cannot be granted at this stage. In the event, the Petitioner prefers a fresh Petition and succeeds, needless to state that he would be entitled for all benefits, including consequential monetary benefits.
