IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 27 WRIT PETITION NO. 191 OF 2025 BALAJI VYANKATRAO HARNAWAL

VERSUS

THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND OTHERS .....

Advocate for the Petitioner : Mr. Mundhe Subhash V. AGP for Respondents/State : Ms. P.V. Diggikar Advocate for the Respondents : Mr. Anil Gaikwad .....

CORAM : MANISH PITALE & Y.G. KHOBRAGADE, JJ.

DATE :

8th September, 2025 P.C. :- 1.

Heard learned counsel for the Petitioner. The learned counsel for the contesting Respondent Nos.3 & 4 seeks time to file reply. 2.

It is vehemently opposed on behalf of the Petitioner on the ground that there is grave urgency in the matter, in the light of the fact that the pendency of this petition without any favourable orders would have the effect of depriving the Petitioner of marks to the extent of 20%, to be taken into consideration in pursuance of selection process initiated by advertisement no.4/2024 for direct recruitment as Advance Skilled Trainee with Respondent No.3.

( 2 ) 27 wp 191.25 3.

The learned counsel for the Petitioner sought to rely upon certain orders passed by this Court to the effect that merely because an offence is registered against a person, that cannot be a ground to refuse selection to the said post. We are unable to agree with the learned counsel for the Petitioner that the effect of the said orders passed by this Court would enure to the benefit of the Petitioner, simply for the reason that the advertisement at Exhibit-F nowhere debars the Petitioner from taking part in the selection process. That, he may lose marks up to 20% is a matter that would have to be considered while finally deciding the present petition. 4.

We also find that the contesting Respondents have already entered appearance and therefore, it would be necessary for them to file their reply affidavits at the earliest.

5.

In view of the above, the Respondent Nos.3 & 4 are granted time of three weeks as a matter of last chance to file reply affidavits. No further time shall be granted.

6.

List for further consideration on 29.09.2025 in the same category.
