Heard the learned Counsel for the petitioners. 2.
When the Court expressed its disinclination to entertain the petition, the learned Counsel for the petitioners seeks leave to not press the petition. The learned Counsel for the petitioners, however, submits that the learned District Judge has imposed costs of Rs.25,000/- on the petitioners, which in the circumstances of the case, is unjustifiable and, thus, may be waived.

The learned Counsel for the respondent - plaintiff, on instructions, submits that the costs may be waived off. 1/2
19-WP348-2026.DOC However, since the purpose of imposition of costs was to disapprove the dilatory conduct of the petitioners - defendants, the hearing of the suit be expedited.

In view of the aforesaid submissions, the petition stands disposed with the modification that the costs of Rs.25,000/- directed to be paid by the defendants - petitioners to the plaintiff stands waived off. The hearing of the suit, however, stands expedited.

The learned District Judge is requested to make an endeavour to hear and decide the suit as expeditiously as possible, and, preferably, within a period of one year from the date of communication of this order.
