CORAM :
N. J. JAMADAR, J.
DATE :
FEBRUARY 13, 2025 P.C:
1.
Heard the learned counsel for the petitioner. 2.
The learned counsel for the petitioner, on instruction, seeks leave to withdraw the petition.
3.
The learned counsel further submits that having regard to the identity of the issues that may arise for consideration in both the suits i.e. RCS Nos. 29 of 2022 and RCS No. 72 of 2019, both the suits may be directed to be tried simultaneously.
4.
I have perused the issues in both the suits. Though the prayer for stay of the suit may not be justifiable, yet, it may be expedient in the interest of justice that both the suits are decided simultaneously.
5.
The petition stands disposed as withdrawn.
6.
The trial Court is requested to hear and decide both the suits, simultaneously.
