Petitioner has alternative and equally efficacious remedy of filing Appeal before the State Government under provisions of sub-section 3 of section 39 of the Maharashtra Village Panchayats Act (the Act) to set up a challenge to the order passed by the Divisional Commissioner removing her from the post of Sarpanch under section 39(1) of the Act. It appears that the Petitioner has already exercised such remedy by lodging Appeal before the State Government on 17 December 2024. It would therefore be appropriate that the Petitioner prosecutes the Appeal before the State Government. Reserving the liberty to the Petitioner prosecute the pending Appeal before the State Government, the Petition is disposed of.

Parties shall appear before the learned Minister on 29 January 2025 and obtain further directions for fixation of date for hearing of the Appeal.
