By the present Writ Petition filed under Article 227 of the Constitution of India, the challenge is to the legality and validity of the order dated 23rd December 2024 passed by the learned Judge, Small Causes Court, Mumbai below Exhibit-97 in R. A. E. Suit No.837 of 2014.

At the outset, Mr. Saraogi, learned Counsel appearing for the Petitioners states that subsequently the said R. A. E. Suit No.837 of 2014 has been decreed vide Judgment and Decree dated 6th January 2025.

In view of this subsequent development, Mr. Saraogi, learned Counsel appearing for the Petitioner seeks withdrawal of the Writ Petition, with liberty to challenge the impugned order in the Appeal, which is proposed to be filed challenging the Judgment and Decree dated 6th January 2025 passed in R. A. E. Suit No.837 of 2014.

Accordingly, the Writ Petition is allowed to be withdrawn with liberty as aforesaid.
