CIVIL APPELLATE JURISDICTION WRIT PETITION NO.625 OF 2025 Rahul Laxman Chaugule and Anr.

.. Petitioners Vs.

The Collector, Kolhapur and Ors.

.. Respondents Mr. Prajakt M. Arjunwadkar with Mr. Prathamesh S. Hande, Ms. Jui B. Gharat and Mr. Raj S. Satam, Advocates for the Petitioners. Mr. S.B. Kalel, Assistant Government Pleader for the Respondent-State of Maharashtra.

CORAM : A.S. CHANDURKAR & M.M. SATHAYE, JJ DATE : 16TH JANUARY 2025.

P.C. :

1.

The petitioners are aggrieved by the order dated 4th October 2024 passed by the Tahsildar in the proceedings under Section 155 of the Maharashtra Land Revenue Code, 1966. Against this order, the petitioners have preferred RTS Appeal No.308 of 2024 and the consideration of the stay application is fixed on 17th January 2025. According to the learned counsel for the petitioners, since the impugned order has been passed after a period of almost thirty-five years, the petitioners seek quashing of the aforesaid proceedings.

2.

We find that the petitioners having availed the alternate remedy, they have to pursue the same by raising all permissible grounds including the ground that the impugned order was passed after inordinate delay. In 1/2 902-WP-625-2025.doc Dixit

that view of the matter, we do not find it expedient to entertain the writ petition.

3.

The writ petition is disposed of as not entertained. It is clarified that all points on merits are kept open for being urged before the SubDivisional Officer. 4.
