Present petition takes exception to order dated 18.11.2025 passed by Family Court, Nanded in Petition C No.7 of 2021 below Exhibit-5, thereby granting interim maintenance to respondents.

The respondents herein instituted proceeding for maintenance under Section 18 and 20 of Hindu Adoption and Maintenance Act before Family Court at Nanded. Admittedly, petitioner is serving and getting monthly salary of about Rs.24,251/-. The income tax returns submitted by him for accounting year 2024-25 also depicts his annual income to the tune of Rs. 2,98,512/-. In this background, the respondent made an application for interim maintenance. The Judge, Family Court allowed the application and directed payment of interim maintenance of Rs.6,000/- per month to
36-wp-694-2026.odt (2) petitioner no.1 and Rs.4,000/- per month to petitioner no.2 from the date of filing application i.e. 05.07.2021.

Mr. Kadam, learned advocate appearing for petitioner would object granting of cumulative maintenance of Rs.10,000/- to respondents on the ground that petitioner is receiving salary of Rs.24,000/- only, he maintains his old aged mother, hence, interim maintenance granted to respondents is excessive and exorbitant. 5.
The aforesaid submissions cannot be countenanced for the simple reason that respondent no.1 is wife. She is residing separately. She requires to care for her daughter given in her custody. In this backdrop, total maintenance of Rs.10,000/- cannot be said to be excessive and exorbitant.

In result, no case is made out to cause interference under Article 227 of Constitution of India. Hence, Writ Petition stands rejected.
