IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 964 WRIT PETITION NO.721 OF 2026 Shailaja Pramod Joshi

VERSUS

The State Of Maharashtra Through Its Secretary And Others ...

Mr. Sushant V. Dixit, Advocate for the Petitioner. Mr. R. S. Wani, AGP for Respondent Nos.1 and 2/State. ...

CORAM : SMT. VIBHA KANKANWADI & HITEN S. VENEGAVKAR, JJ.

DATE : 22 JANUARY 2026 ORDER :

.

Present petition has been filed for following relief :- "A) For a writ of mandamus or a writ in the nature of mandamus or any other appropriate writ, order or direction, directing respondent No.2 to decide Appeal No.208 of 2019 pending before it expeditiously and within a stipulated period as this Hon'ble Court deems fit, preferably within three months."

2.

Learned AGP seeks accommodation for taking instructions from respondent No.2.

3.

It appears that Appeal No.208 of 2019 is pending before respondent No.2. We have perused the roznama. Though in the recent [1]

964-wp-721-2026.odt years it appears that both the parties are absent, but their Advocates are present. The Advocates appear to have not insisted that the matter should be heard. It appears that on 03.07.2025 written notes of arguments have been filed on behalf of the appellants. Thereafter, on 24.07.2025 the arguments of one side have been heard then again the appellants have given Exhibit-25, for which the present petitioner has taken time to file say. If both the Advocates cooperate with the Court, definitely the Court is bound to take the matter, but if the insistence is not shown, then the matter may get prolonged. No doubt, the appeal is pending since 2019. and, therefore, there are directions from this Court for expeditious disposal of such cases. We hope and trust that the concerned Court will adhere to the instructions on the administrative side. No necessity to make the case time bound for disposal.

4.

Writ Petition stands dismissed.
