The praecipe is moved for seeking direction in the Writ Petition by the Respondent wife. According to the Respondent, she has been intimated by the school to pay the second quarter fees for the academic year 2025-2026 up to 15th June 2025. According to learned counsel for the parties, quarter one fees was paid by the Petitioner husband, however quarter two fees has not yet been paid. As per the Order passed by this Court on 20th February 2025, the statement of the Petitioner who was personally present in the Court was recorded. He had undertaken to pay an
amount of Rs.22,350/- towards the school fees of his son towards quarter one, for a period of 15th March 2025 to 31st March 2025. 2.
Learned counsel for the Petitioner submits that that fees has already been paid. He further contends that, apart from that he is going to pay transportation charges which are Rs.19,000/-. According to him, though the Petitioner has paid the fees as well as the transportation charges, he is being denied access to the child in the months of April and May 2025. Admittedly, as per the Order dated 26th February 2025 he was allowed access on 09th March 2025 and 16th March 2025. After access according to the Order dated 26th February 2025, he has been denied access to the child. It is informed that the mediation is pending before the Mediator, Senior Advocate Mr. R.S. Apte. Hence, considering the fact that the mediation is pending, the statement of the learned Counsel for the Petitioner is accepted, who undertakes to pay quarter two fees as demanded by the school directly to the account of school before the due date, and details of which shall be provided by the learned Counsel for the Petitioner. 3.
In the meanwhile, in continuation of the Order dated 26th February 2025 the Respondent shall give access of the minor son
to the Petitioner on 2nd and 4th Sunday between 11:00 a.m. to 01:00 p.m. of every month on mutually agreed place, till the pendency of the proceedings. So far as this month is concerned, since second Sunday has already gone, the Respondent shall give access of the son to the Petitioner on 15th and 29th June 2025. 4.
