The learned advocate for the petitioner submits that the proceedings are pending before the Debt Recovery Tribunal (DRT). According to him, the order dated 22.09.2025 has not been complied with by the borrower. He further submits that his application, which is pending before the Tahsildar for implementation of the order dated 10.03.2025 passed under Section 14 of the SARFAESI Act, be directed to be decided and the possession of the property be handed over. 2.

When it is pointed out that the proceedings are pending before the DRT and the learned advocate appearing for the borrower submits that he has deposited the entire amount of Rs.50,00,000/- along with

923-WP-825-26.odt {2} an OTS proposal, this Court would not be in a position to adjudicate the issue when the proceedings are pending before the DRT. 3.

Learned advocate for the petitioner, upon taking instructions from the petitioner, seeks leave to withdraw the petition with liberty to make the appropriate application before the DRT within a period of two weeks from today.

Leave granted.

The writ petition is permitted to be withdrawn with liberty as prayed for. All the issues are specifically kept open. 6.

In view of the withdrawal of the writ petition, Civil Application No. 2318 of 2026 for intervention does not survive and the same also stands disposed of.
