1 935WP1053.2026.odt
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 935 WRIT PETITION NO. 1053 OF 2026 Chhotu Dinkar Salunke And Others
VERSUS
The State Of Maharashtra And Others ...
Mr. Majit S. Shaikh - Advocate for the Petitioner Miss Neha B. Kamble - AGP for State ...
CORAM : SMT. VIBHA KANKANWADI AND HITEN S. VENEGAVKAR, JJ.
DATED : 30TH JANUARY, 2026 PER COURT : - 1.
The present petition has been filed for direction to Respondent Nos. 1 to 6 to decide the Representations and release the salaries of the respective Petitioners forthwith. 2.
It appears, that the salaries from June-2023 to August-2023 have not been paid to the Petitioners and, therefore, we had directed the learned AGP to seek instructions. She has taken instruction from Respondent No. 4 and submits that, the salary of the said period was withheld as there was shortage of documents. Now those documents have been supplied and the salary would be released within a period of six weeks.
3.
We are of the opinion that the Respondent No. 4 cannot withhold the salary for uncertain period. Now the deficiencies have been
2 935WP1053.2026.odt cleared and, therefore, we direct the Respondent No. 4 to release the salary of the respective Petitioners pending between June-2023 to August-2023 within a period of fifteen (15) days from today. 4.
The learned AGP, upon instructions from Respondent No. 4, submits that the salary bills from October-2025 onwards are under scrutiny and after scrutiny is over, the decision would be taken for disbursement of the salaries.
5.
Here also, when the Respondent No. 4 is getting his salary regularly, he should not take unnecessary time to scrutinise the salary bills of the Petitioners. We, therefore, direct the Respondent No. 4 to scrutinise the salary bills from October - 2025 till today within a period of fifteen (15) days and disburse the salary immediately. If there is any genuine defect i.e. any document is remained to be submitted, then he should immediately call for the same from the concerned Institution and see that the salaries of the Petitioners are released. 6.
Place the matter for further consideration on 27 th February, 2026.
