Heard the learned counsel for the parties.

The learned counsel for the parties submit that the parties have arrived at a settlement with regard to the reference of the ARUN RAMCHANDRA SANKPAL dispute to arbitration.

The learned counsel for the parties seek leave to tender the minutes of order.

The minutes of order are taken on record and marked 'x'. 5.

The Writ Petition stands disposed in terms of the minutes of order 'x', which read as under :- Vina Khadpe

By consent of the Petitioner and Respondent No. 2, Larsen & Toubro Limited, the disputes forming part of the subject matter of the present Writ Petition are hereby referred to arbitration as per Clause 18 of the Terms and Conditions of the Work Order. The said clause mandates arbitration in terms of the Arbitration and Conciliation Act, 1996 to held at Chennai.

The parties have mutually agreed to the appointment of Hon'ble Mr. Justice M. Govindaraj (Retd.) Madras High Court as the Sole Arbitrator, who is based in Chennai, to adjudicate the disputes which form the subject matter of the present proceedings.

All rights and contentions of both parties, are expressly kept open to be agitated before the Ld. Sole Arbitrator on its own merits. Parties agree that the arbitrator's fees and other costs will be shared equally by the parties 4.

The present Writ Petition is accordingly disposed of. 5.

There shall be no order as to costs."

The learned Arbitrator is requested to file his disclosure statement under Section 11(8) read with Section 12(1) of the Act, 1996 within two weeks with the Registrar (Judicial-I) of this Court and provide copies to the parties.

8.

Parties to appear before the Sole Arbitrator on a date to be fixed by him at his earliest convenience.
