These petitions are directed against the orders passed by the AGRC, whereby an application preferred by the petitioners for grant of interim relief during the pendency of the Appeal Nos. 287/2024 and 301/2024, preferred by the petitioners in 1/4
WP Nos. 17131/2025 and 1127/2026 respectively, came to be rejected.

The petitioners have challenged the acceptance of the proposal submitted by Maharaj Realtors - Respondent No. 11 for development of Slum Rehabilitation scheme in respect of New Shramjivi SRA CHS (proposed), Shree Shramjivi SRA CHS (proposed) and Ashirwad CHS (proposed) situated on the plot bearing land CTS No. 61 (pt) of Shramjivi Nagar, part of Chembur.

The substance of the grievance of the petitioners, in WP No. 17131/2025, is that, the petitioners had submitted the proposal on 28th June, 2018 and the said proposal was revised on 26th September, 2018. The proposal of the petitioner was rejected on 23rd September, 2024. In the meanwhile, while the proposal of the petitioners was still under consideration, the SRA has accepted the proposal of Maharaj Realtors - Respondent No. 11 on 01st February, 2021. During the pendency of the proposal of the petitioners, the SRA could not have scrutinized and accepted the proposal of the Maharaj Realtors - Respondent No. 11. Reliance is placed on the judgment of the learned Single Judge of this Court in WP No. 1769/2023 (Vilas Rambhau Chaudhari Vs. Slum Rehabilitation Authority & Ors.). 2/4

The AGRC was not inclined to grant interim relief, as the AGRC was of the view that, the proposal submitted by Maharaj Realtors - Respondent No. 11 was at very initial stage. Nonetheless, the AGRC has directed that, any progress in the said Slum Rehabilitation scheme shall be subject to the outcome of the appeal.

Mr. Khandeparkar, the learned Counsel for the petitioners submitted that, in the event the proposal of the Maharaj Realtors - Respondent No. 11 progresses and LOI is issued, the rights of the petitioners would be irretrievably prejudiced. 7.
As the petitioners are assailing an interim order while the appeals are awaiting adjudication before the AGRC and the AGRC has recorded a view that, the proposal of the Maharaj Realtors is at initial stage, this Court does not find it expedient to entertain the petitions in exercise of writ jurisdiction. Instead the Court is inclined to direct the AGRC to hear and decide the appeals preferred by the petitioners as expeditiously as possible. 8.
The Court is informed that, the AGRC is scheduled to hold its sitting on 06th February, 2026.

The AGRC is requested to list Appeal Nos. 287/2024 and 301/2024 for hearing on 06th February, 2026, and make an endevour to hear and decide those appeals as expeditiously as possible and, preferably, within a period of two months thereafter.

The petitions stand disposed.
