The first proposal of the Petitioner was responded to by the communication by the Education Officer (Secondary) dated 16.6.2020, listing out 17 deficiencies/requirements.

The learned Advocate for the Petitioner submits that the minority Institution Management has responded on 6.2.2023. The learned AGP submits that, that was not a response to the Notice dated 16.6.2020.

In view of the above, we grant liberty to the Management Respondent Nos. 6 and 7, to consider the communication dated Talwalkar
36.WP1162.2025.odt 16.6.2020, copy of which is placed on record and which is marked as 'X' for identification and the Management shall tender the required documents and remove the deficiencies within 30 days from today. Thereafter, the present Education Officer (Secondary), would consider the revised proposal and keeping in view that 17 objections/deficiencies were already listed out, no further objections shall be raised and the proposal shall be considered on its own merits by passing a reasoned order within 45 days thereafter.

In the event an adverse order is passed, the aggrieved party is at liberty to avail of a remedy as is permissible in law. If the approval is granted, steps to allot Shalarth I.D. shall be initiated expeditiously. 5.
The Petition is disposed off accordingly.
