Heard the learned Counsel for the petitioner. 2.
When the Court expressed its disinclination to entertain the petition, the learned Counsel for the petitioner, on instructions submits that, the petitioner may be granted time to file an additional written statement to deal with the amendment allowed by the impugned orders and, in the event, a decree is eventually passed against the petitioner and the petitioner is required to file an appeal there-against, the petitioner's right to assail the legality and validity of the impugned orders, be kept open.

The petition stands disposed with liberty to the petitioner to file an additional written statement in view of the amendment SAINATH 1/2
33 WP 1214-26.DOC in the plaint pursuant to the impugned orders, within a period of one month from today.

The petitioner is also at liberty to assail the legality, propriety and correctness of the impugned orders, in the event, an appeal is filed against the decree that may be eventually passed in the suit, under Section 105 of the Code of Civil Procedure, 1908.

Subject to aforesaid clarification, the petition stands disposed.
