Heard the learned advocate for the Petitioners and the learned AGP for the Respondent State. Perused the Petition paper book with their assistance.

Normally we are not inclined to direct an out of turn hearing and decision in pending proceedings before the Courts in the District judiciary, or other forum, merely because the Petitioner has approached the High Court. All litigants are equal, and each has a desire that his or her proceedings should be decided expeditiously. We cannot direct an out-of-turn hearing in favour of a litigant Vina Khadpe

However, there are exceptions and one exception is that an Application seeking approval to the amendments sought to be incorporated in the Constitution of a Trust. Such application has to be decided urgently. This is the prayer of the Petitioner.

The learned AGP submits that, despite her best efforts, she was unable to acquire instructions from the officers of the Charity Commissioner. She submits that if the Petitioners' Application for seeking amendment in the Constitution / Scheme is pending, the same can be decided urgently.

In view of the above, this Petition is disposed off. 6.

We expect the Respondent No.2 Assistant Charity Commissioner, to consider the pendency of such Applications seeking amendment to the Constitution / Scheme and considering the date of lodging of the present Petitioner's Application, the same may be decided expeditiously.
