2026:BHC-AUG:7913 903-wp-1634-2025.odt (1)
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 1634 OF 2025 Bapurao Shankar Rathod And Others
VERSUS
The State Of Maharashtra Through The Secretary And Others ...
Advocate for the Petitioner : Mr. Kulkarni Mukul S. AGP for Respondent/State : Mr. K.B. Jadhavar Advocate for Respondent No.2 : Mr. V.J. Dhage WITH WRIT PETITION NO. 1285 OF 2025 ...
CORAM : S. G. CHAPALGAONKAR, J.
DATED : FEBRUARY 18, 2026 PER COURT :- 1.
Both writ petitions take exception to order dated 06.01.2025 passed by learned Joint Charity Commissioner, Latur below Exhibit 5 and 6 in Appeal Nos.43 of 2024 and 44 of 2024. 2.
Undisputedly, substantive appeals filed by respective parties are pending before Joint Charity Commissioner. Interim arrangement is made by impugned order, whereby Trustees who were incharge of management of trust as per last change report were directed to administer day-to-day affairs of trust and with guard they shall not take a policy decision. Apparently, this arrangement is temporary in nature and does not prejudice any of the parties, but, it is in interest of administration of trust.
3.
In that view of matter, instead of delving into merits of contention, purpose would be served if learned Joint Charity
903-wp-1634-2025.odt (2) Commissioner expeditiously decides pending appeals on merit after hearing parties. Apparently, there is no impediment for expeditiously deciding appealsp on merit. Hence, following order :
ORDER
(i) Both Writ Petitions stand disposed of with direction to learned Joint Charity Commissioner to decide pending appeals within a period of three months from today.
