DATE :

9TH FEBRUARY 2026.

PC:

1.

Heard learned counsel for the petitioner. All the respondents are represented by the learned AGP.

2.

Since the petitioners seek a limited direction in the present petition, we are inclined to take up the petition for disposal today itself. 3.

A perusal of the documents filed with the writ petition shows that the petitioners had moved an application on 11th May 2022, before the Respondent No. 3- Executive Engineer, Irrigation Department, Pune, for payment of compensation, as part of the land belonging to the petitioners was utilized under an irrigation canal. It appears that there was no response

from the said respondent and therefore, a reminder application was submitted before the said respondent on 7th July 2025. Copies of the documents show that both the applications were indeed received, but till date there is no response.

4.

We are of the opinion that the respondents, particularly respondent No. 3 should have responded to the applications made by the petitioners. We also find that the question regarding compensation or necessary steps to be taken in that regard would be more appropriately considered by the concerned Special Land Acquisition Officer for appropriate orders. 5.

In view of the above, the writ petition is allowed in terms of prayer clause (a) by directing the respondents to consider the aforesaid applications dated 11th May 2022 and 7th July 2025 addressed by the petitioners to Respondent No. 3.

6.

The Respondent No. 2- Collector is directed to place the said applications before the concerned Special Land Acquisition Officer also, in order to comprehensively consider the grievance of the petitioner. 7.

The applications of the petitioners shall be decided within six weeks from today. It is made clear that this Court has not expressed any opinion on the merits of the matter.

8.

The petition is disposed of. Pending applications, if any, also stand disposed of.
