IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 922 WRIT PETITION NO. 1324 OF 2026 Bharat Eknath Koli

VERSUS

The State Of Maharashtra And Others ......

Mr. Amol S. Mali, Advocate for Petitioner (absent) Mr. S.B. Pulkundwar, AGP for Respondents-State ......

CORAM : SMT. VIBHA KANKANWADI AND HITEN S. VENEGAVKAR, JJ.

DATE : 05 FEBRUARY, 2026 PER COURT :- 1.

The present petition has been filed for direction to respondent No.3-Tahsildar, Shirpur to lodge a formal complaint under Section 195 of the Code of Criminal Procedure against the persons who filed false affidavits in Vahivat Dava No.17/2023, and further to direct respondent No.4-Police Inspector, Thalner Police Station to register the FIR. 2.

Though the learned advocate for the petitioner is absent, we have considered the documents on record. After the application was made by the petitioner for taking action under Section 195 of Cr.P.C., it appears that the order came to be passed by learned Tahsildar, Shirpur on 25.11.2025 and he rejected the said application. Now, it is for the petitioner to take further legal steps, and certainly it cannot be under

922-WP-1324-26.odt {2} the writ jurisdiction of this Court. It also appears that the petitioner had given a complaint application to Thalner Police Station, and under the Right to Information Act, he has received confirmation that the said application was filed, and information regarding the same was given to the petitioner. Therefore, no question arises for the grant of any relief as prayed in the petition, since the petitioner is required to pursue the appropriate legal remedy.

3.

The writ petition stands dismissed.
