CORAM

: AMIT BORKAR, J.

DATED : FEBRUARY 25, 2025 P.C.:

1.

The present matter has been placed before the Court upon a praecipe filed by Mr. Godbole, learned Advocate for Respondent No.1, seeking leave to speak to the minutes of the order dated 20 February 2025. The order in question pertains to the allocation of appearances as recorded in the proceedings previously drawn up by this Court.

wp1332-2025 with wpst4045-2025 final-speaking.doc 2.

Mr. Godbole submits that he appears solely on behalf of Respondent No.1 and does not represent Respondent Nos.2 and 3. However, the impugned order reflects, in error, that his appearance extends to all three respondents. The learned Advocate urges the Court to correct this inadvertent misstatement to accurately reflect his representation in the instant proceedings. 3.

Having heard Mr. Godbole and upon perusing the material on record, the Court deems it just and proper to direct the necessary rectification in the notes of appearance. Accordingly, the appearance of Mr. Godbole shall be recorded strictly on behalf of Respondent No.1 and not for Respondent Nos.2 and 3. 4.

In furtherance of clarifying the reasons precipitating the nonissuance of notice to Respondent Nos.2 and 3, it is hereby directed that the order dated 20 February 2025 shall stand modified by the insertion of Paragraph No.15 in the judgment, duly delineating the factual matrix and legal considerations that guided the Court's decision in this regard.

5.

The modified order, incorporating the aforesaid rectification, shall be uploaded as Order No.2 in the present proceedings, so as to ensure a faithful and transparent record of the Court's findings and directions.

6.

The parties are at liberty to act upon an authenticated copy of this order for all requisite purposes and proceedings connected herewith.
