Dr. Milind Sathe, learned Senior Advocate representing the respondent no.1 on instructions submits that the petitioner had secured a total of 42 marks in Paper-II-Criminal Law. As against question no.2, he had secured 5 marks out of 16. However, the marks scored were incorrectly recorded as 2 out of 16. Insofar as question no.5 is concerned, the petitioner had scored 4 marks out of 16. The marks awarded are incorrectly shown as 3 out of 16. Thus the total marks secured are 42 and not 38. He further submits that+ if a candidate secures more than 40 marks, his 1/2

Since the petitioner has scored more than 40 marks, it is directed that the exercise of moderation of the petitioner's answer paper in Paper II-Criminal Law be undertaken by the respondent no.1 within a period of one week.
