The petitioners impugns the order dated 17.7.2018 passed below Exhibit-75 and order dated 14.10.2025 passed below Exhibit-115 by the learned Civil Judge J.D. Bhadgaon, District-Jalgaon in RCS No.20 of 2012.

Mr. Randhir, learned advocate appearing for petitioners submits that by impugned order, learned trial court has given directions to refer sale-deed dated 16.4.1983 (Exhibit 56) and sale-deeds placed at Exhibit-57 and 58 to the hand writing expert. By inviting attention of this Court to the documents at Exhibit-56 and 57, he would point out that those were the index to documents and not the original sale-deeds. Even those documents do not bear original signatures of plaintiffs.

wp 1371.26 corrected.odt Mr. Randhir further invites attention of this Court to the documents which are at Exhibit-63 and 64 on record of the Trial Court and points out that those are the original documents, wherein signature of plaintiff can be found. If the aforesaid contentions are accepted, it would be for the trial court to re-consider or review its own order. 3.

In that view of the matter, writ petition stands disposed of, with liberty in favour of the petitioners to file an application for review before the Same Court, who shall consider the same on its own merits and pass further orders accordingly. ( S. G. CHAPALGAONKAR, J. ) ...
