The petition arising out of rejection of an application under Section 73A of Maharashtra Public Trusts Act, 1950. On perusal of the record, it appears that such application appears to have been filed in a Change Report in relation to an election held in the year 1984. The period of managing committee from 1984 to 1989. It is undisputed that during the said period, there is no allegation of fraud or forgery. Moreover no measure policy decision regarding sale or purchase of immovable property was taken. Therefore, in my opinion, the situation is covered by the Co-ordinate Bench judgment of this Court in the case of Jagatnarayan Swarupsingh Chithere Vs. Swarup Singh Education Society and Anr, 1980 Mh. L.J. 372 Hence, the Change Report No. 2352 of 1994 is,

42-WP 1395-25.doc therefore, disposed of as has been rendered academic. In that view of the matter, the petition, therefore, stands disposed of. 2.

In view of this order, Revision Application filed by respondent Nos.3 and 4 is also rendered infructuous. (AMIT BORKAR, J.)
