The petitioner filed an application before the Authorities under the provisions of the Maharashtra Prevention of Fragmentation and Consolidation of Holdings Act, 1947, it is well settled that, such application needs to be filed within reasonable period, this Court has categorically held in large number of matters that exercise of powers under Section 31A of the Act is not permissible after period of 3 years of the finalization of scheme. 2.
However, the petitioner filed such application after the period of 40 years. The State Government, therefore, has rightly allowed the revision filed by the aggrieved party on the ground
18-wp-1472-2025.doc that the modification has sought by the petitioner under Section 32(1) could not have been done after period of 40 years. It is also well settled that the correction of the clerical and arithmetical as contemplated under Section 37A, no limitation will apply, if the person applies under Section 37A for corrections of the clerical or arithmetical errors in judgments or orders, and the Authorities are bound to correct such errors.
