The petitioners are the legal heirs of an employee who was working with respondent Nos. 3 and 4 and had met with an accident while working in a company due to blast of drum filled with chemicals. He had suffered serious burn injuries and during the course of the treatment, he expired on 25.08.2017. The petitioner therefore, had filed Workmen's Compensation Application No. 19/2018 before the Labour Court and the Commissioner for Employee's Compensation, Aurangabad against the respondent Nos. 3 and 4 for grant of compensation. On 10.01.2023, by judgment and order, the application came to be allowed and the respondent Nos. 3 and 4 were held liable to pay jointly and severally the amount of Rs. 6,39,200/- with interest at the rate of 12% from the date of accident i.e., 18.08.2017 till its realization.

In pursuance of the judgment and order, the Commissioner for Employee's Compensation and Judge, Labour Court issued Revenue Recovery Certificate on 03.06.2024 and the copy of the same was also forwarded to the Collector as the recovery certificate stood in the name of Collector for executing the said certificate and recover the amount of compensation from respondent Nos. 3 and 4.

Said recovery certificate remain to be executed till date and, therefore, the petitioners have approached this Court seeking directions to the Collector, Sambhajinagar to execute Revenue Recovery Certificate and recover the amount of compensation from respondent Nos. 3 and 4. 3.

Learned AGP appearing on behalf of respondent Nos. 1 and 2, on instructions, states that the Recovery Certificate was in fact forwarded to Gangapur for execution. However, now they have realized that it needs to be recovered in Aurangabad itself at MIDC Waluj. He further makes a statement that the Recovery Certificate will be recalled from Gangapur and thereafter, it will be executed within a period of six months from today.

We accept the statement of the learned AGP and direct the respondent No. 2 to execute the Revenue Recovery Certificate within a period of three months from today. As the certificate is dated 03.06.2024, and since then it is pending execution, respondent No. 2 was accordingly abide by the statement of the learned AGP and orders of this Court.
