Heard Mr. Butala, learned Advocate for Petitioners. 3.

After going through Writ Petition and impugned order dated 03.09.2025 appended at page No.60 and roznama appended at page No.15 I expressed my disinclination to Mr. Butala to interfere with the order of stay and status quo.

Be that as it may after taking instructions Mr. Butala would submit that Petitioners are willing to withdraw the Petition but persuades the Court to give directions for expeditious determination of pending RTS Appeal. That undoubtedly the Court can exercise its discretion and pass appropriate orders in that regard. 5.

Learned Additional Collector (Appeals) is directed to dispose

P8.WP.1623.2026.doc of pending RTS Appeal No.299 of 2025 appended at page No.70 to the Writ Petition as expeditiously as possible and in any event within a period of six weeks from today. All contentions of the parties are kept expressly open. Any objection raised by Petitioners with respect to the stay of the order of roznama pending before the concerned Authority shall stand disregarded and nothing shall be held against the Appellants otherwise.

Needless to state that RTS Appeal shall be disposed strictly on its own merits and in accordance with law after hearing both the sides.

Copy of this order and copy of Writ Petition shall be placed before the learned Additional Collector for his information tomorrow i.e. 13.02.2026 at 12:00 Noon.

With the above directions, Writ Petition is disposed as withdrawn.
