Challenge in this writ petition is to an order of disqualification of the petitioner as the candidate belonging to backward class on his failure to submit caste validity certificate from Caste Scrutiny Committee.

It is not in dispute that the petitioner's claim as a candidate belonging to the Scheduled Tribes, "Mahadev Koli" has been rejected by the Caste Scrutiny Committee. The writ petition challenging the judgment of the Caste Scrutiny Committee is pending before the Division Bench of this Court. There is no adinterim relief in the said petition.

In the absence of interim relief in a petition challenging refusal to grant validity to the caste certificate issued in favour of the petitioner, the impugned order disqualifying the petitioner from being continued as member of Grampanchayat need not be interfered with.
