The order impugned has been passed in exercise of powers under Section 22(4) of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971. The Appellate Authority has remanded proceedings back to the first authority. Therefore, service to the respondent No.2 looses its significance.

The first authority shall decide the application under Section 22 of the said Act in accordance with law.

The writ petition stands disposed of in above terms. No costs.
