Present writ petition takes exception to the order of disqualification passed by the District Collector, Hingoli against petitioner under section 10(1-A) and section 30(1-A) of the Maharashtra Village Panchayats Act.

Record indicates that petitioner was elected from Reserved Category on 18.1.2021, but could not submit caste validity certificate within statutory period of 12 months in terms of undertaking given at the time of submissions of the nomination. It appears that petitioner has received validity certificate on 2.2.2024, however because she failed to file it within statutory period, vide order dated 31.12.2024 she has been declared disqualified.

Although, petitioner has subsequently received validity certificate, it was inconsequential. She had suffered automatic disqualification, as has been declared under impugned order passed by the District Collector, Hingoli. Therefore, there is no merit in the writ petition.
