Challenge in this writ petition is to an order passed by the State Government in exercise of power under Section 154 of the Maharashtra Cooperative Societies Act, 1960 thereby granting stay to an order passed by the Inquiry Officer under Section 88 of the Maharashtra Cooperative Societies Act, 1960 despite certificate under Section 98 issued against the managing committee members.

Considering the reasons assigned in the order under Section 88 of the Maharashtra Cooperative Societies Act, 1960, the State Government could not have granted stay to such order by unreasoned order. Hence, the petitioner has made out a case for grant of ad-interim relief.

Hence, until further orders, there shall be ad-interim relief in terms of prayer clause (b).

Issue notice to respondent Nos.4 to 13, returnable on 7 April 2025.

It is clarified that pendency of this writ petition shall not preclude the State Government from deciding the revision application.
