The petitioner is a member of Satyawadi Cooperative Housing Society, Erandwane, Pune. By an order dated 17th October, 2024 passed by the Assistant Commissioner, Social Justice & Welfare Department, Pune, the membership of the petitioner has been cancelled and the petitioner has been asked to surrender the tenement on the ground that the petitioner is using the same for commercial purposes. 2.

Learned counsel for the petitioner submits that writ petition involving similar issue has been entertained and interim order has been granted by this Court. In support of the aforesaid submission, he placed reliance on the order dated 24th October, 2024 in Writ Petition No. 15795 of 2022 passed by a coordinate Bench of this Court.

In view of the aforesaid submission and with a view to maintain parity, issue notice to the respondents, returnable on 11th March, 2025.

Learned Additional Government Pleader waives service of notice on behalf of respondent nos.1 to 3. 5.

It is directed that no coercive action shall be taken in pursuance of the order dated 17th October, 2024 against the petitioner, if not already taken, till the next date of hearing. 6.

List on 11th March, 2025 along with Writ Petition No. 11404 of 2024.
