Heard learned counsel for the petitioners.

The petitioners are seeking relief to direct the respondents to issue the appointment orders to the petitioners and allow the petitioners to join the duties as per Dinesh Sherla 1/2

2-0-cwp-1920-25.doc call letters dated 23rd May 2019, subject to outcome of the pending cases before the Central Administrative Tribunal, Mumbai (Tribunal) filed by the other aggrieved persons. Further direction is sought to the respondents to award the deem date effect and service benefits to the petitioners from the date on which they become eligible for their appointments.

Shri. Garge, learned counsel appearing for the respondents, invited our attention to the order dated 1st August 2024 passed by this Court in Writ Petition No. 5416 of 2024. We find that the matters filed by some of the aggrieved persons are already pending before the Tribunal. In any case, the petitioners' remedy would be to approach Tribunal for the reliefs sought for in this petition in view of the provisions of Chapter - III of the Administrative Tribunals Act. 4.

Keeping all contentions open and granting liberty to the petitioners to approach the Tribunal, we dispose of the petition.
