1] Pursuant to the judgment in Writ Petition No.14475 of 2023 (Dr. Vilas s/o Raghunath Dukare vs. The State of Maharashtra and Others) dated 26/04/2024 passed by the Aurangabad Bench, the petitioner seeks entitlement to admission at the Post Graduate Medical Course M.D. Medicine for Academic Year 2024-2025. It is submitted that despite cancellation of the Economically Weaker Section Certificate that was issued to respondent no.6, the petitioner has been deprived of BDP-SPS 1/2

2 915 WP-1998-25.doc admission. The learned counsel for the respondents seeks time to file affidavit-in-reply. Time of one week is granted to file affidavit-in-reply. It is submitted that the cut off date for seeking admission to the Post Graduate Post is till today and if that date is not extended the petitioner would lose this Academic Year.

2] Without prejudice to the rights and contentions of the respondents and without conferring equities in favour of the petitioner, in case all necessary requisites are complied with by the petitioner and a vacant seat in the Course of M.D. Medicine is available, same shall not be filled-in till the next date of the proceedings. 3] Stand over to 07/03/2025.
