The only grievance raised by the petitioner is the time taken to consider Miscellaneous Application No.104 of 2023 by the Debts Recovery Tribunal - 3, Mumbai. Securitization Application (Lodging) No.1173 of 2022 filed by the petitioner was not registered on the ground that the office objections had not been removed. This order was passed on 3rd April 2023. Thereafter the petitioner filed Chamber Appeal No.1470 of 2023 along with Miscellaneous Application No.104 of 2023 seeking condonation of delay. The proceedings were to be listed on 24th December 2024. However it is informed today that the next date of the proceedings is 8th August 2025.

In these facts, the following directions would serve the ends of justice :- 1/2 8-WP-2154-2025.doc Dixit

(i) The petitioner is permitted to file an application seeking expeditious consideration of Miscellaneous Application No.104 of 2023 along with Chamber Appeal No.1470 of 2023.

(ii) If such an application is moved, the same shall be considered and decided expeditiously in accordance with law.

Keeping all points on merits open, the writ petition is disposed of with aforesaid directions.
