The Petitioner is in Employment with Respondent No.3. He is 49 years of age. His claim of belonging to the 'Koli Mahadev' Scheduled Tribe Category, is pending adjudication since 21st November, 2020. He is under a threat of termination. 2.
Since an innocuous prayer is put forth, this Writ Petition is disposed off with the following directions :-
(a) The Committee would enter into a correspondence with the Petitioner on his E-mail Address, which is purushottampatil1975@gmail.com.
(b) The Petitioner shall render wholehearted cooperation to the Committee in the expeditious adjudication of his claim. (c) Since the learned AGP submits that the Vigilance Cell Inquiry Report is awaited, let the report be tendered within a period of 30 days from today. A statutory hearing notice of 15 days, would be served upon the Petitioner vide his E-mail Address along with the copy of Vigilance Cell Report. (d) Within a period of 15 days thereafter, the Petitioner would tender his written explanation along with written notes of submissions/case law, if desired.
(e) The Committee shall decide the claim of the Petitioner, on or before 30th June, 2025.
(f) The Petitioner's service shall be protected, provided he tenders an affidavit undertaking, within a period of 21 days from today in this Court, as well as with Respondent No.3, declaring that he would not seek further increments/pay
revision/promotion/service benefits etc., until his claim is validated either by the Committee or by this Court. (ASHWIN D. BHOBE, J.) (RAVINDRA V. GHUGE, J.)
