In hundreds of matters, we have noticed that when we passed an order by issuing notice to the Respondents and marked the presence of the learned AGP on behalf of the State, we observed that the reply be filed, at least, one week prior to the returnable date. 2.

To enable the State to have sufficient time to file a

Trupti 7-wp-2250-2025.odt reply, we normally make the notice returnable after around 5 to 6 weeks. The purpose behind doing so is to ensure that the reply is filed with a sufficient time span to prepare it and the matter is not kept lingering in our Court, since the hearing is obstructed by the non-filing of the reply.

The State is one of the biggest litigant before the Court. Despite our above directions, replies are not filed. Time and again, we keep on granting adjournments and the matters are adjourned beyond 3 to 6 months. The above aspect needs to be dealt with by a responsible Officer of the State Government. Let this order be brought to the notice of the learned Advocate General. 4.

List these Petitions on 28th March, 2025.
