The Respondent No.3 Sub Divisional Officer and Competent Authority, Pandharpur, has refused to issue the 'Koli Mahadev' Scheduled Tribe category, to the Petitioner. The Petitioner's Appeal before Respondent No.2, the Scrutiny Committee, is rejected on the ground of delay. 2.

We have considered the submissions of the learned Advocate for the Petitioner and the learned AGP. 3.

Considering that the delay is neither deliberate, nor inordinate, this Writ Petition is allowed.

The impugned order dated 29th May, 2024 passed by Respondent No.2, is quashed and set aside and the proceedings are remitted to Respondent No.2, to be considered on its own merits. 5.

We clarify that that the Petitioner has contended that her grandfather Haribhau Maruti Parchande has a 'Koli Mahadev' Scheduled Tribe certificate, along with his three biological brothers, namely, Mohan, Baban and Narayan. This aspect may be considered by the Committee, along with all other aspects, on their own merits. 6.

Let the above exercise be completed, within a period of 45 days from today.
