The petitioner being aggrieved by the issuance of Recovery Certificate by the order dated 14th August 2014 has preferred Revision Petition under Section 154 of the Maharashtra Co-operative Societies Act, 1960. During pendency of those proceedings, the Circle Officer has sought to execute the Recovery Certificate.

It is informed that the Revision Petition is being considered today by the Divisional Joint Registrar, Co-operative Societies. It would be open for the petitioner to seek appropriate interim relief in the aforesaid pending proceedings.

Officer for taking possession of the secured asset is concerned, the date mentioned was 22nd January 2025. Possession was not taken on that date. In case any fresh notice is issued to the petitioner, he is free to seek appropriate relief in accordance with law.

Keeping all points on merits open, the writ petition is disposed of with aforesaid directions.
