The present Writ Petition takes exception to order dated 03.08.2023 passed by Labour Court, Aurangabad in Miscellaneous ULP (delay) 01/2023, whereby Petitioners prayer to condone a delay of 12 days caused in filing complaint has been rejected. 2.
Learned Advocate appearing for Petitioners invites attention of this Court to reasons mentioned in support of delay condonation, wherein it is stated that Petitioners and family members were facing economic duress and they lost time in collecting required expenditure for filing complaint. 3.
The Labour Court found that aforesaid explanation is not sufficient to condone delay of 12 days.

It is evident that complaint has been filed alleging unfair labour practices against respondent/employer, whereby Petitioners have been orally terminated vide order dated 17.06.2022.

Looking to nature of litigation, pragmatic approach is required to be adopted in the matter of condonation of delay. It cannot be said that Petitioners have intentionally delayed filing complaint or derived any benefit by making such delay.

In light of aforesaid factual aspect and considering law laid down by Supreme Court in case of Collector, Land Acquisition, Anantnag & Anr. Vs. Mst. Katiji & Ors., 1987 AIR 1353, a case is made out to condone the delay. 7.
In view of above, Writ Petition is allowed in terms of prayer clauses 'B' and 'C'.
