IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 2433 OF 2025 Pushpa Chandrakant Pandit ... Petitioner versus The State of Maharashtra & Ors.

... Respondents ---- Mrs.Manisha Devkar for the Petitioner.

Mrs. P.N.Diwan, AGP for Respondent Nos. 1, 2, 4, 5 and 6, State. --- CORAM :

RAVINDRA V. GHUGE & ASHWIN D. BHOBE, JJ.

DATE : 08TH APRIL, 2025 P.C. :- 1.

We have considered the vehement submissions of the learned Advocate for the Petitioner and the learned AGP. 2.

The dispute is as to whether the present Petitioner Pushpa is the legally wedded wife of the deceased Chandrakant Krishnat Pandit or whether Minakshi is his legally wedded wife. 3.

In Regular Civil Appeal No. 150 of 2016, to which the present Petitioner Pushpa was not added as a Respondent, the learned Extra Jt. District Judge, Pandharpur has delivered a

Trupti 911-wp-2433-2025.odt judgment on 10th January, 2022 declaring Minakshi to be the legally wedded wife and to be entitled for the pensionary benefits since Chandrakant Pandit passed away during the pendency of the Appeal. 4.

The learned Advocate for the Petitioner submits, on instructions, that Pushpa has now initiated steps with reference to the judgment dated 10th January, 2022 delivered in Regular Civil Appeal No. 150 of 2016.

5.

The learned AGP has relied upon the judgment delivered by the Full Bench of this Court in Kamalbai w/o. Venkatrao Nipanikar vs. State of Maharashtra and others1. 6.

In view of the above, this Writ Petition is disposed off. 7.

Needless to state, if the Petitioner avails of any legal remedy in connection with the judgment dated 10th January, 2022, delivered in Regular Civil Appeal No. 150 of 2016, all contentions are kept open.
