Heard the learned Counsel for the parties.

The challenge in this Petition is to an order dated 6th October 2025 passed by the Maharashtra State Human Rights Commission, Mumbai ("the Human Rights Commission"), whereby the Petitioner has ARUN RAMCHANDRA SANKPAL been directed to pay a compensation of Rs. 12,00,000/- (Rs. Twelve ARUN RAMCHANDRA SANKPAL Date: 2026.05.08 14:38:18 +0530 Lakhs) to the Maharashtra State Legal Services Authority ("the MALSA").

After the Petition was heard for sometime on 27th April 2026, this Court had enquired with the learned Counsel for the Petitioner as to whether the amount of compensation directed to be paid to "MALSA" 1/3

can be paid to the Chief Medical Officer, Pandit Madan Mohan Malviya Shatabdi Hospital, Govandi, Mumbai, for providing medical facilities to the patients.

Mr. Patil, the learned Counsel for the Petitioner, has tendered a communication addressed by the Chief Medical Officer, Pandit Madan Mohan Malviya Shatabdi Hospital, Govandi Mumbai, to the Assistant Law Officer of the Municipal Corporation which discloses that the hospital requires one USG machine, the cost of which can be approximately Rs.12,00,000/- (Rs. Twelve Lakhs only) inclusive of 3 years warranty and 5 years of Comprehensive Maintenance Contract. 5.

Mr. Patil submitted that the Petitioner-Corporation is willing to transfer the said amount of Rs.12,00,000/- (Rs. Twelve Lakhs only) to the account of Chief Medical Officer, Pandit Madan Mohan Malviya Shatabdi Hospital, Govandi, Mumbai.

Ms. Rajani, the learned Counsel for Respondent No.2 concurs with the aforesaid proposal.

Since the object of awarding compensation was to ameliorate the situation of the patients who approach Pandit Madan Mohan Malviya Shatabdi Hospital, Govandi, Mumbai, that objective would be better achieved if the amount of Rs.12,00,000/- (Rs. Twelve Lakhs Only) is placed at the disposal of the Chief Medical Officer of the said Hospital. 2/3

The Petition stands disposed with the modification of the impugned order to the effect that, the Petitioner shall transfer a sum of Rs.12,00,000/- (Rs. Twelve Lakhs only) to the Chief Medical Officer, Pandit Madan Mohan Malviya Shatabdi Hospital, Govandi, Mumbai, for procuring one USG machine and for any other purpose which benefits the patients, if any amount remains unspent after procurement of USG machine.
