All these Petitioners are permanent employees of the APMC, Respondent No. 6 herein. Their grievance is that the APMC has now commenced a procedure for recruiting people through public employment on particular posts. According to the Petitioners, they are suitable for being promoted.

We called upon the learned Advocates for the Petitioners to point out as to whether there is any service rule or a service condition by which the positions occupied by these Petitioners can be said to be a feeder cadre for the promotional posts and whether they can be promoted Talwalkar

14.WP2582.2025.odt in view of the service conditions. It is submitted that there is no rule which indicates that the post occupied by the Petitioners can be said to be a feeder cadre.

In view of the above, we record that if the Petitioners are eligible, they may also be compete for occupying the posts which are now being advertised. If they are found to be eligible and suitable, there would not be any impediment for considering them for promotion. We make it clear that we have not expressed any view about the merits of the claims of the Petitioners.
