After Mr. Zal Andhyarujina learned senior counsel for the petitioner opened the arguments on behalf of the respondent, an objection was taken that this is a tender matter, therefore, it ought not to be heard by this bench. Mr. Zal Andhyarujina has responded that this is not a tender matter as the issue pertains to blacklisting of the petitioner in regard to the contract which was already executed.
