IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO.2671 OF 2025 Dilip Arjun Bhuruk Petitioner versus Tushar Suryakant Mutake and others Respondents Mr.Vilas B.Tapkir, Advocate for Petitioner.

Ms.Dhruti Kapadia, AGP, for Respondent no.10 CORAM :

AMIT BORKAR, J.

DATE :

26th February 2025 PC :

1.

The challenge in this petition is to the order passed by Additional Divisional Commissioner, Pune Division, in RTS Appeal No.823 of 2019, dated 8th September 2017, in exercise of power u/s.257 of Maharashtra Land Revenue Code based on mutation entry. The record indicates that a registered instrument is the subject matter of civil suit. Therefore the Additional Divisional Commissioner has rightly observed that the mutation entry was the subject to the civil suit.

2.

Hence, without prejudice to the rights of the Petitioner to ventilate his grievance in civil suit in relation to the validity of instrument, present petition is disposed off. (AMIT BORKAR, J.) MST MANISH SURESHRAO THATTE Date: 2025.02.26 16:45:05 +0530 MANISH SURESHRAO THATTE
