Heard the learned Counsel for the parties.

A limited prayer of the Petitioners is that the application for temporary injunction preferred by the Petitioners in RCS No.131 of 2020 (Exh.5) be heard expeditiously, as in the intervening period, third party rights are being created in the suit properties and the Plaintiffs are forced to implead the transferees as party Defendants to the suit, thereby further delaying the disposal of the suit.

It appears that, number of applications have been filed in the suit, and, therefore, the application for temporary injunction could not be effectively heard and decided by the Trial Court. Since the application for temporary injunction is filed in the suit instituted in the year 2020 and the record indicates that a number of Defendants have been impleaded in the suit, it SSP 1/2
39 wp 2683 of 2026.doc would be appropriate that the learned Civil Judge decides the application for temporary injunction (Exh.5) as expeditiously as possible. 4.
The Writ Petition, thus, stands disposed with a request to the learned Civil Judge to decide the application for temporary injunction (Exh.5) in RCS No.131 of 2020 as expeditiously as possible and preferably within a period of four months from 16 April 2026, the next schedule listing of RCS No.131 of 2020.
