It is clarified that this Court has not entered into the merits of the matter, in regard to the claim of the petitioner that, he is a legatee under the Will purportedly executed by the deceased and, in the event, any proceeding is instituted by the petitioner, the same shall be decided on its own merits and in accordance with law.
